Indore: Indore bench of the Madhya Pradesh High Court on Friday issued a stay on the notice issued by the Kolkata cyber crime branch asking BJP general secretary Kailash Vijaywargiya to appear for questioning in connection with a case.
Cyber crime police had issued a notice against Kailash Vijayvargiya under section 160 of CrPC asking him to appear for questioning. Vijayvargiya has filed a petition in the High Court challenging this notice.
The matter was heard by Justice Subodh Abhyankar on Friday. Arguments were made on behalf of Vijaywargiya that due to political vandetta, he is being called for questioning. Vijaywargiya’s advocate claimed in the court that Vijaywargiya has nothing to do with the case. After hearing the arguments, the court has sought a response from the West Bengal government, putting a stay on the implementation of the notice. The next hearing in the case will be after six weeks.
The court said, “Considering the fact that a notice under Section 160 of CrPC has been issued to the petitioner, who is resident of Indore, around 65 years old and also considering the contentions of senior advocate for the petitioner that the Kolkata Police has no jurisdiction to issue such notice, which has already been held by this court to be without jurisdiction dated 15.11.2017, this court finds it expedient to stay the operation of impugned notice dated 23.05.2021. In view of the same, the operation of the impugned notice dated 23.05.2021 is hereby stayed.”
